Brief Overview:

During the morning session Troy Kindly will discuss basic understandings of the brain, brain disorders, and how these issues present to professionals who come in contact with persons with brain impairment.  Tools that can be used to assess for capacity will be presented as well as practical tools for how to interview a person with developmental delay, cognitive impairments and diminished capacity.  Case presentations and extended question and answer forum will follow so all concepts are brought together in a cohesive manner.   

For the afternoon session, Elder law attorney Wes Fitzwater and litigation attorney Jessie Minger of Fitzwater Meyer Hollis & Marmion will discuss how legal and financial capacity differs from diagnostic capacity. This will include training on Powers of Attorney, Revocable and Irrevocable Trusts, Guardianships, Conservatorships. Learn how they work and how to spot the subtle red flags. Learn how a former Multnomah County DDA now pursues Civil Financial cases, and what remedies are available when there is insufficient evidence to pursue criminal prosecution.  Questions and case histories are encouraged.
